Old Lyme Board of Selectmen
Regular Meeting: Monday, May 17, 2010


The Board of Selectmen held a regular meeting at 4:00 PM on Monday, May 17, 2010 in the Meeting Hall of the Old Lyme Memorial Town Hall. First Selectman Timothy Griswold, Selectman Skip Sibley and Selectwoman Bonnie Reemsnyder were present.

1. ~Approval of Minutes – 3 May 2010, 10 May 2010 (special), 13 May 2010 (special)
Selectwoman Reemsnyder moved to accept the minutes of May 3, 2010 and Selectman Sibley seconded the motion.  SO VOTED.
Selectman Sibley moved to accept the minutes of May 10, 2010 and First Selectman Griswold seconded the motion. Selectwoman Reemsnyder was absent and therefore abstained.  SO VOTED.
Selectman Sibley requested the following sentence be added to the end of the last paragraph of 1. WPCA Ordinance Amendment: First Selectman Griswold will confer with Attorney Clarke concerning the proper procedure to remove this item from the call of the Annual Town Budget Meeting.  Selectman Sibley moved to accept the minutes of May 13, 2010, as amended, and Selectwoman Reemsnyder seconded the motion.    SO VOTED.

4. Old Business
a. Town Budget – First Selectman Griswold reminded people that the Annual Town Budget Meeting will be held at 7:30 PM tonight at the Middle School Auditorium

        b. WPCA Ordinance Amendment – Recommend Tabling – First Selectman Griswold reported that the Board of Selectmen cannot remove this item from the call of the Annual town Budget meeting because there were less than five days before the meeting to do so.  Accordingly, there will be a motion to table proposed.

        c. Bus Barn Update – Machnik Brothers has completed grading the site, installing the drainage and pouring the building foundation.  The septic system has been installed, the water service is nearly complete and the modular building has been placed on the foundation.  Most of the unknowns have been resolved and the project should be completed in the middle of June.  

        d. Church Corner Update - First Selectman Griswold stated that there will be a meeting with a representative of American Industries (AI), AI’s attorney, Mrs. Sturges, First Selectman Griswold and the Town’s attorney on May 20th.  The goal is to negotiate a resolution of the issues concerning the Church Corner project.  All seem eager to resolve the differences and complete the work.

        e. Town Hall Expansion Update – There will be a meeting on Friday with the firm that prepared the HVAC evaluation study, the design firm and representatives from the Town to review the report.  Selectman Sibley suggested that the Town Hall Building Committee be invited but First Selectman Griswold believes the technical people need to review the report and then update the Committee about recommended courses of action.  The Town’s attorney will also advise on hiring Zelek Electric to install the photovoltaic system.

        f. FEMA Meeting Update – Because the President did not authorize FEMA Individual Assistance, Governor Rell has urged affected citizens to report damage to their property via a 211 hotline.  FEMA maintains that the property in eastern CT did not suffer sufficient damage to kitchens and bedrooms in order to qualify for aid, so the 211 information may change this.  Old Lyme property owners are urged to submit information via the 211 phone line.

5. New Business
        a. Frank Maratta – Sound View Bus Request for 20 June – First Selectman Griswold reported that Mr. Maratta, owner of the Pavillion in Sound View, requested permission for two busses to come down Hartford Ave. on Father’s Day (20 June) at 11:00 AM to drop off passengers at the Pavillion and return at 6:00 PM to retrieve them.  The purpose is to provide a safe way for the passengers to drink, without driving.  First Selectman Griswold believes this request is at odds with the bus ordinance but the Selectmen would like more information before acting on the request.

        b. Blood St. Sculls – Request to Use the Town Truck – Kyn Tolson requested permission for the Blood St. Sculls to use the Town pick-up truck and to pay Don Saunders, a Public Works employee, to drive the truck to various regattas in and out of state.  This request has been granted over the last few years, but it does create wear and tear on the truck and could expose the Town to liability.  The Board will invite Ms. Tolson to amplify on the request at the next Board of selectmen’s meeting.  Selectwoman Reemsnyder moved to allow the Blood St. Sculls to use the truck for the June 6th regatta and Selectman Sibley seconded the motion.  SO VOTED.

7.  Public Comment - None

8.  Other Business
        a. Selectman Sibley asked about the status of the Boulanger lawsuit.  They are suing the Town because it denied their request to obtain a parking permit  for property they own in Sound View.  First Selectman stated that this involves ongoing litigation and should be discussed in Executive session.  Atty. Clarke will be asked to update the Board at a future meeting.
        b. First Selectman Griswold thanked Girl Scout Troop 63204, leaders Nancy Meesham and Vicki Urbowicz and parents for cleaning up litter at seven Town boat launches in Old Lyme.  The Scouts worked on this project over two days.
        c. Selectman Sibley asked about the status of the proposed expansion of the Rogers Lake boathouse, as suggested by the Rowing Association.  First Selectman Griswold said that representatives of the Association met with Betty Osga, Supt. of Schools, John Rhodes, Dist 18 Facilities Director, and First Selectman Griswold several weeks ago.  The Association described preliminary plans but there were many questions raised and there has not been a subsequent meeting.  It was agreed Greg Hack, President of the Association, should organize another meeting.
        d. The Selectmen discussed the question about whether the Senior Center is a 501 (C) 3  non-profit corporation or not.  Selectwoman Reemsnyder, who is a Senior Center Board member, suggested this matter be put on the Senior Center Board agenda in June so that answers may be forthcoming

The next Board of Selectmen's meeting will be held on Monday June 7th at 7:30 PM.

9.  Adjournment – Selectwoman Reemsnyder moved to adjourn the meeting at 5:46 PM and Selectman Sibley seconded the motion.  SO VOTED.
